Following a Public Interest Litigation (PIL) filed by a Haryana Resident named Gaurav Yadav, the Delhi High Court asks the Centre to respond to it. The matter that is circling is the question of having only a few Caste groups for the recruitment of Presidential Bodyguard. The man's application was not accepted and the recruitment procedure was not taken forward. This raised the question of why? To which on research Gaurav found this out.
The PIL was filed in the Delhi High Court. Looking at the people and positions involved in this matter, the high court has asked the Central Government's response to the litigation. An official word was also forwarded to the Chief of the Army Staff regarding the plea in the court.
Alleging that only three Castes were considered for the recruitment of the President's Bodyguard, Gaurav filed a plea on the recruitment drive which was held on September 4th of 2017. Jats, Rajputs and Jat Sikhs only were invited for application and for further higher processes.
Special Bench of judges was assembled together for the case. Justices S Muralidhar and Sanjeev Narula have issued an official notice to the Ministry of Defence, Chief of the Army sTaff, Commandant of the President's Bodyguard and Director of Army Recruitment, concerning the petition.
The bench further said, " Reply shall be filed within four weeks. The rejoinder, if any, shall be filed before the next date. List on May 8, 2019". The original PIL was actually put up requesting the recruitment procedure held last year September be put aside on halt.
In the petition, Gaurav said that he belonged to the Ahir/Yadav caste and fulfilled all the other criteria required. Moreover, he requested that the other criteria be considered duly and given the opportunity to hold the post. The caste was the only things that he could not fulfil and as it seemed discriminatory, filed a petition.
Advocate Ram Naresh Yadav, through whom the PIL was filed says, "The Preferential treatment, that is being provided to the three castes has deprived other citizens, who were also eligible, of the opportunity of recruitment". Details of the plea include the following technically lawful terms and statements.
"The recruitment criteria so formulated and followed contains an arbitrary classification which is based on caste and henceforth, it is in the nature of class legislation, stands in complete violation of Article 14 of the Constitution of India."
"Also, the recruitment process stands in violation of Article 15(1) which prohibits discrimination on the basis of race, religion, caste, sex, colour and place of birth".
